Cooley secured a decisive win for Scynexis in a putative securities class action under Sections 10(b) and 20(a) of the Securities Exchange Act of 1934. The case is Feldman v. Scynexis, Inc. et al (Case No. 2:23-cv-22082) before the US District Court for the District of New Jersey. The Cooley team representing Scynexis includes partners Shannon Eagan and Brett De Jarnette, special counsel Caroline Pignatelli, and associates Amanda Jereige and Priya Gambhir.

Cooley advised Egnyte, a provider of secure content collaboration and governance solutions, on its strategic growth investment from GI Partners and TA Associates.

Cooley secured the complete dismissal of a securities class action regarding Revance’s statements about US Food and Drug Administration approval prospects. The court dismissed all claims with prejudice.

Cooley successfully secured the complete dismissal of a derivative action for FibroGen – a biopharmaceutical company that discovers and develops medicines for the treatment of anemia, cancer and fibrotic disease – as well as certain officers and directors. The case is In re FibroGen Inc. Derivative Litigation, C.A. No. 2022-0331-SG (Del. Ch.).

Cooley successfully narrowed the class period, thereby substantially reducing the plaintiffs’ potential damages, in a securities class action against client FibroGen – a biopharmaceutical company that discovers and develops medicines for the treatment of anemia, cancer and fibrotic disease.
