About Brett

Brett handles high-stakes business disputes in federal and state court. He focuses on securities class actions, derivative litigation and defending companies in investigations conducted by the Securities and Exchange Commission and Department of Justice. Brett also counsels companies and their directors and officers on corporate governance, disclosure obligations and mitigating litigation risk. He has represented public and private companies in industries such as biotech, internet, social media, fintech, hardware and software.

  • Obtaining voluntary dismissal for Overstock.com in a securities class action
  • Obtaining complete dismissal for Ellie Mae (ICE Mortgage Technology) in derivative litigation
  • Defending BioMarin in two securities class actions
  • Defending Geron in a securities class action and derivative litigation
  • Defending a global technology company in a consumer class action
  • Defending a top social networking company and two former officers in a securities class action
  • Defending Kik Interactive in an SEC investigation and enforcement action centering on Kik’s sale of cryptocurrency called “Kin”
  • Defending a large internet company at trial against misappropriation of trade secrets and breach of contract claims
