Ephraim is a partner in Cooley’s Supreme Court and appellate practice. He represents clients in high-stakes litigation, with a particular focus on appellate and US Supreme Court matters and complex questions of statutory or constitutional interpretation. He has argued five cases before the Supreme Court, including significant victories on issues of free speech, tax and healthcare, as well as multiple cases before federal and state appellate courts. He previously served in the Office of the Solicitor General at the US Department of Justice, where he represented the federal government before the Supreme Court in roughly 80 cases, including in the areas of securities, financial regulation, administrative law and foreign affairs. He was a principal architect of the government’s litigation strategy in major constitutional cases implicating the Affordable Care Act (ACA), Dodd-Frank Act and American Rescue Plan. Ephraim also served in the Office of the White House Counsel, where he provided legal advice and strategic counseling to senior White House and agency officials on economic regulatory issues.
