Cooley secured an appellate win on behalf of IonQ, a quantum computing hardware and software company, in the US Court of Appeals for the Fourth Circuit, affirming the original dismissal of the securities class action and ruling that plaintiffs cannot adequately plead loss causation by relying on a self-interested short-seller report based on anonymous sources.

Cooley today filed an amicus brief on behalf of social and racial justice nonprofits in TikTok Inc. and ByteDance Ltd. v. Merrick B. Garland (US Court of Appeals for the DC Circuit) challenging the federal legislation banning TikTok – a modern-day digital town square used by more than 150 million US users to engage in First Amendment-protected expression – on free speech and equal protection grounds.

Cooley, alongside the American Civil Liberties Union (ACLU) and the ACLU of Georgia, filed a motion on behalf of the National Women’s Law Center to intervene as a defendant in a pending lawsuit against the NCAA that seeks to block transgender women and girls from playing NCAA sports, to bar transgender women and girls from using women’s facilities, and to erase records of past participation by transgender women and girls in NCAA sports.

Cooley, alongside the American Civil Liberties Union (ACLU), ACLU of West Virginia and Lambda Legal, secured a win for client Becky Pepper-Jackson in B.P.J. v. West Virginia State Board of Education before the US Court of Appeals for the Fourth Circuit.

Cooley, alongside co-counsel from Protect Democracy, filed an amicus brief with the US Supreme Court on April 8, 2024, in the case of Trump v. United States on behalf of 19 retired four-star generals and admirals and former secretaries of the Army, Navy and Air Force opposing former President Donald Trump’s assertion of presidential immunity from criminal prosecution.
