Dave Fletcher is special counsel in the government contracts practice group. He rejoined Cooley in 2013 and is resident in the Washington, DC office. Dave advises clients on legal and contractual matters related to their government business, including the meaning and effect of FAR and agency FAR supplement clauses, prime contractor/subcontractor negotiations, flowdowns, disputes, domestic preferences and domestic source restrictions (for example, the Buy American Act ("BAA") and Trade Agreements Act ("TAA")), GSA Schedule and other commercial item contracts, and government contractor compliance obligations and processes. He counsels clients on small business set-asides and assistance programs in federal contracting, including the 8(a) Business Development, Small Business Innovation Research ("SBIR"), Service-Disabled Veteran-Owned Small Business ("SDVOSB"), and Women-Owned Small Business ("WOSB") programs, as well as small business waivers of FDA new drug application fees. Dave devotes a significant portion of his counseling practice to advising on mergers and acquisitions and other corporate transactions involving government contractors.
