Advances in the digital marketing and delivery of financial products and services have outpaced black-letter consumer protection laws, which still refer to fax machines. The Consumer Financial Protection Bureau and Federal Trade Commission are pursuing advanced marketing practices through a host of novel legal theories, utilizing a mix of guidance, enforcement and litigation. In this session, we analyzed recent regulatory developments governing digital delivery of products and services, and we discussed practices subject to regulatory scrutiny.
