Supreme Court and Appellate

Why Cooley

For decades, clients have turned to Cooley to defend them in pivotal cases that shape the future. Our powerhouse Supreme Court and appellate team is crafting the legal arguments that will define key industries for years to come.

Our team features lawyers with significant, high-level government experience who bring unmatched insight to cases before the Supreme Court and federal appellate courts, as well as in litigation involving federal and state governments. Led by former US Solicitor General Elizabeth Prelogar, who served from 2021 to 2025 and has argued 35 cases before the Supreme Court, our team includes a former Assistant to the Solicitor General, a former  Deputy Assistant Attorney General in the Civil Division of DOJ, and other senior attorneys from DOJ and the White House, along with a bench of former clerks for Supreme Court Justices and federal and state judges.

In addition to litigating before the Supreme Court and appellate courts, we identify, brief and argue pivotal issues at the earliest stages of litigation, guiding cases through every level. From defending artificial intelligence breakthroughs to challenging new Food and Drug Administration regulations, we fiercely advocate for our clients on first-of-their-kind legal issues shaping industries.

Our team works collaboratively across Cooley’s litigation and regulatory practices – from commercial and securities litigation to intellectual property and antitrust. We provide clear, winning arguments that marshal subject area knowledge and technical depth.

With deep roots in major legal markets and extensive experience litigating in federal and state courts nationwide, Cooley’s appellate team is built for national impact. From briefing and arguing dispositive motions in district courts in New York, DC and California to handling complex circuit court appeals and arguing the most consequential cases before the Supreme Court, Cooley develops and delivers winning arguments at all stages of litigation.
