About Summer

Summer McKee’s practice focuses on both the transactional and litigation aspects of Chapter 11 bankruptcy reorganizations and liquidations across a wide range of industries, including retail, technology, health care and life sciences. She frequently represents creditors' committees and debtors, and regularly advises clients regarding a variety of matters related to the reorganization process, including, among other things, section 363 sales, trade creditor and landlord rights, and plan confirmation issues.

Prior to joining Cooley, Summer was an associate at Debevoise & Plimpton where her practice focused on representing both debtors and creditors in complex Chapter 11 restructurings and liquidations as well as advising clients on insurance insolvency matters. From 2014 – 2015, she served as law clerk to Judge Elizabeth S. Stong of the US Bankruptcy Court for the Eastern District of New York.

While in law school, Summer interned with the Office of the Attorney General of the State of New York’s Bankruptcy Division and, in 2014, received the National Association of Women Lawyers Outstanding Law Student Award. She also served as an articles editor for the Brooklyn Law Review.

Representative experience includes:

  • Representing the official committees of unsecured creditors in some of the most prominent chapter 11 cases in the country, including Mallinckrodt Pharmaceuticals, J.C. Penney, Claire’s Stores, Brookstone, Rockport, and True Religion
  • Representing debtors in their chapter 11 proceedings across various industries, including Charlotte Russe, Ascena Retail Group, Inc., hhgregg, Altegrity,* and the Big Apple Circus*
  • Conducting investigations and litigating fraudulent conveyance, preference, breach of fiduciary duty, and other causes of action on behalf of unsecured creditors and liquidating trustees, including the representation of the Liquidating Trustee of Health Diagnostic Laboratory
