Reed Smith is a special counsel in the litigation department at Cooley and joined in 2007. Reed's practice focuses on commercial litigation and white-collar criminal defense. In addition to first-chair trial experience, he is an experienced and accomplished appellate litigator.

Recent matters include:

  • Representation of a group of securities law professors as amici curiae before the Second Circuit in United States v. Newman, a widely-publicized insider-trading prosecution.
  • Representation at trial of the bankruptcy estate of a clothing retailer in a commercial leasing dispute (judgment for our client on all claims).
  • Representation at an arbitral hearing of a technology firm in a patent licensing dispute (second chair) (award for our client).
  • Representation of technology and life sciences companies in contract disputes involving investment relationships, manufacturing and commercial leasing.

  • "Recent Developments in Restitution Law," LJN: Business Crimes Bulletin, January 2015.

Reed has also taken a leading role in highly complex matters handled by the firm, including the representation of a global chemical company in a contract dispute arising from a $1 billion merger; the representation of an international law firm on claims of legal malpractice; the representation of a former partner of an international law firm at two securities fraud trials, on appeal, and in related S.E.C. proceedings and civil litigations; and the representation of an individual in a felony prosecution arising from investments made by the New York State Retirement Fund.

His legal career began as a Staff Attorney with the Legal Aid Society in New York City, where his practice centered on criminal and capital appellate litigation. Prior to joining Cooley, he served for two years as law clerk to the Honorable Robert S. Smith, Associate Judge of the New York State Court of Appeals.
