
About Kelton
Kelton represents foreign and domestic corporations involved in high-stakes litigation, with a focus on cross-border disputes in the ecommerce and technology sectors. She handles a broad range of disputes – including multijurisdictional contract and business torts disputes, privacy and data security, trade secret misappropriation, unfair competition, and other statutory and common law claims.
Kelton also regularly advises foreign and domestic clients on litigation avoidance strategies – including corporate governance and regulatory compliance, alternative dispute resolution policies, privacy and data security, consumer regulatory concerns, advertising and marketing claims, and intellectual property protection.
Before joining Cooley, Kelton was seconded to Google Play, where she worked closely with product teams to launch new products/features and update existing products/features.
During law school, Kelton externed for the Enforcement Division of the US Securities and Exchange Commission. Before law school, Kelton worked for a venture capital firm focused on seed and Series A investments in startup technology companies.
Kelton maintains an active pro bono practice, working regularly with nonprofit partners focused on transparency and community involvement in decisions related to juvenile justice.
Kelton’s recent representative matters include:
- Obtained a complete defense award, which included substantial fees and arbitration costs, on behalf of a large investor-owned utility company following a multiweek arbitration over a failed renewable energy project; the claimant, the project developer, asserted various contract claims and sought millions of dollars in damages
- Attained dismissal for a video and mobile game developer in the Superior Court of California against alleged violations of California’s Consumer Legal Remedies Act and Unfair Competition Law relating to claims that “loot boxes” in video game apps constitute unlawful gambling devices
- Advised a blockchain developer on policies for an employee token incentive plan
- Drafted an acceptable use policy for a decentralized autonomous organization (DAO)
- Assisted in an internal investigation for an electronics manufacturer involving trade secret misappropriation
- Advised an ecommerce company on website consumer-facing terms and conditions and a loyalty rewards program
