About Josh
Josh is an experienced appellate advocate and strategic counselor. He has briefed high-stakes cases in the Supreme Court of the United States and federal and state courts of appeals and has presented oral argument in 10 appellate matters. Drawing on his time serving as a political appointee and career attorney at the US Department of Justice (DOJ), Josh has particular substantive experience in constitutional law and administrative law litigation and advising.
Before joining Cooley, Josh held critical roles in DOJ. Most recently, he was senior counsel to Associate Attorney General Vanita Gupta, where he advised her and DOJ’s senior leadership on priority antitrust, civil, bankruptcy, Tribal and environmental matters. As counsel in DOJ’s Civil Division, Josh defended various administration policies, including by coordinating the federal government’s litigation surrounding COVID-19 healthcare policies. In both of these roles, Josh advised cabinet agencies and the White House on litigation risk and other legal and policy issues. As an attorney on the Civil Division’s Appellate Staff from 2018 to 2020, Josh briefed and argued dozens of cases, including presenting oral argument and securing reversal of a $479 million judgment against the United States.
Josh also previously worked as counsel in another firm’s Supreme Court and appellate litigation group, where he served as the principal drafter of briefs on behalf of content creators challenging the constitutionality of the Protecting Americans from Foreign Adversary Controlled Applications Act. He also represented media companies in First Amendment litigation; successfully obtained a new trial for an insurance company; and briefed intellectual property, administrative law, constitutional law and employment law disputes. Josh also maintained an active pro bono practice, focusing on criminal, administrative and immigration law matters. His oral and written advocacy persuaded the US Court of Appeals for the Fourth Circuit to vacate his client’s sentence and reduce his period of incarceration by 7.5 years.
Josh clerked for Justice Elena Kagan of the Supreme Court and Chief Judge Merrick B. Garland of the US Court of Appeals for the DC Circuit. He graduated from Yale Law School, where he received the Potter Stewart Prize for best overall oral and written advocacy during moot court and the Benjamin Scharps Prize for best paper by a third-year student. He is a summa cum laude graduate of Yale University.
