About Bingxin

Bingxin has a broad practice in complex commercial litigation, appeals, government and internal investigations, and international arbitration. She represents individuals and companies in high-stakes commercial disputes in a wide range of areas, including securities class actions, shareholder derivative litigation, contractual disputes and tort claims. Bingxin also frequently represents individuals and companies in internal investigations and criminal and regulatory matters involving the Department of Justice (DOJ), the Securities and Exchange Commission (SEC) and the Financial Industry Regulatory Authority. She has represented public and private companies across a variety of industries.

Bingxin’s representative matters include:

Commercial litigation

  • Defending a fintech company and its directors and officers in a securities class action in the US District Court for the Southern District of New York and in a shareholder lawsuit in the Delaware Court of Chancery.
  • Defending a biopharmaceutical company and its directors and officers in a securities class action in the US District Court for the Eastern District of New York.
  • Defending a manufacturer of batteries and energy storage systems against breach of fiduciary duty claims and an appraisal action arising from a going private transaction in the Delaware Court of Chancery.
  • Defending current and former directors and officers of CenturyLink in shareholder derivative suits in the US District Court for the District of Minnesota.
  • Represented a premier electric car company, along with its current and former directors and officers, in defending a securities class action in the US District Court for the Northern District of California arising from a potential going private transaction.
  • Achieving successful dismissal of a securities class action against Meredith Corporation and its current and former directors and officers in the US District Court for the District of Iowa and in the US Court of Appeals for the Eighth Circuit.
  • Achieving successful dismissal of a breach of contract and fraud action against a securities trading business and its equity holders in the New York Supreme Court (currently on appeal in the Appellate Division, First Department).

Government investigations

  • Defending a telecommunications company in SEC, DOJ and state attorney general investigations.
  • Defending an ecommerce company in SEC and DOJ investigations.

International arbitration

  • Representing a top technology company in international disputes involving digital advertising under International Centre for Dispute Resolution Rules.

Pro bono

  • Obtaining a favorable settlement for a Chinese American scientist for her wrongful prosecution and termination from her job.
  • Representing the New York Legal Assistance Group in Freedom of Information Act litigation against federal agencies.
