Optotraffic Secures Dismissal With Prejudice in Federal Fraud Class Action
Washington, DC – November 3, 2025 – Cooley successfully defeated a putative class action lawsuit for its client Optotraffic, an industry leader in automated traffic enforcement and public safety technology.
The suit alleged fraud, racketeering, deceptive trade practices and other tort claims in connection with the company’s lawful collection of traffic enforcement fees on behalf of municipalities and local law enforcement agencies in the state of Georgia. The plaintiff previously filed a federal class action in the US District Court for the Middle District of Georgia before dismissing that case and refiling a similar class action in Georgia state court.
Cooley removed the case to the US District Court for the Northern District of Georgia, successfully opposed the plaintiff’s motion to remand the case back to Georgia state court, and moved to dismiss the class action for failure to state a claim. Instead of opposing Optotraffic’s motion to dismiss, on October 31, the plaintiff dismissed her suit once again. This dismisses her claims with prejudice under the two-dismissal rule.
