Win for Facebook Named a Top Verdict of 2015

February 22, 2016

Palo Alto – February 22, 2016 – The Daily Journal named Bascom Research LLC v. Facebook to its Top Verdicts of 2015 list in the defense category. The list recognizes the case’s broad impact on the law and industry.

Cooley achieved the victory for Facebook in January 2015. Bascom claimed that several Facebook features, including the ability to “Friend” other users, infringed four of its patents. A federal judge tossed the lawsuit, saying that the patents describe abstract ideas and do not pass the U.S. Supreme Court’s Alice test, a decision which clarified the standards of patentability of computer-based inventions.

“As defendants illustrate at length, the concept of establishing and using relationships between documents is a common, age-old practice,” wrote Judge Susan Illston in her ruling.

The Cooley team advising Facebook included Heidi Keefe, Mark Weinstein, Lowell Mead, Erin Pritchard and Carrie Richey.
