Cooley Trial Win Named 'Top Verdict of 2013' by the Daily Journal

San Diego, Calif. – February 19, 2014 – Cooley LLP announced today that Moser v. Encore Capital Group has been selected to the Daily Journal's "Top Verdicts of 2013" list in the ‘Top Defense Results' category. To be selected to the list, cases had to have a broad "impact on the law, an industry, or society."

In September 2013, a team of Cooley attorneys won a complete defense verdict for client Encore Capital in a jury trial in the U.S. District Court for the Southern District of California. Encore Capital is a leading provider of debt management and recovery solutions for consumers and property owners across a broad range of assets.

The plaintiff in the case was Encore's former General Counsel and Senior Vice-President, Timothy Moser. Moser alleged that the company breached a confidentiality agreement with him when it disclosed information about his termination in an SEC filing. Moser sought $7.3 million in damages including 350,000 stock options and other compensation. 

The Cooley team was led by partner Michael Attanasio, chair of the firm's litigation department, and included associates Ryan Blair and Lindsay Parker.
