As AI drives unprecedented demand for compute power, data centers have emerged as critical infrastructure shaping the future of innovation, economic competitiveness and digital sovereignty. From retrofitting legacy sites to developing next-generation campuses, scaling infrastructure to meet AI’s requirements presents complex legal, regulatory and commercial challenges.

This session will examine the converging forces reshaping the data center landscape – including power strategy, permitting constraints, environmental, social and governance (ESG) and land use pressures, and the emergence of AI-native infrastructure needs. It will be led by a Cooley team with decades of experience in the heart of Virginia’s Data Center Alley, the largest concentration of data centers in the world. We’ll explore key legal considerations in data center development and transactions, how stakeholders are navigating financing and ownership structures, and what this all means for hyperscalers, emerging tech companies and investors alike.

 Attendees will gain insight into the evolving digital infrastructure market – and how to position ahead of accelerating demand for AI-ready capacity.
