Foreign direct investment (FDI) transactions are becoming more complex across Europe. The European Commission’s Foreign Subsidies Regulation will come into effect in July 2023, giving it another enforcement tool to review FDI transactions. In addition, new regimes are being introduced across Europe – with each one having its own regulations and enforcement tools. C5’s 4th European Forum on FDI Reviews and CFIUS delved into the critical changes affecting professionals working in foreign direct investment screening regulations.

Status Report on Outbound Controls in the European Union
Cooley special counsel Christine Graham spoke on this panel.
The European Commission announced in 2022 that it will reexamine whether additional tools are needed regarding outbound strategic investment controls. This announcement came on the heels of similar US- proposed legislation – the National Critical Capabilities Defense Act (NCCDA). During this session, delegates learned how proposed outbound controls could affect investments into China and Russia.
