New Business Bankruptcy Amendments

Jay Indyke, a partner in the Firm's Bankruptcy & Corporate Restructuring Department, recently co-authored one of the first published articles on the new business bankruptcy amendments which go into effect on October 17, 2005. The article is entitled "New Bankruptcy Code Amendments: Major Changes Shift Leverage in Favor of Special Interests" and appears in two parts in the July/August and September 2005 editions of the ABF Journal. The article highlights changes that, in the opinion of the authors, are surprisingly dramatic in business insolvencies, will directly impact debtors, lenders and creditor constituencies, and are likely to make the process of corporate renewal in Chapter 11 more difficult and contentious.
