Industrial Biotech Subcommittee: In re U.S. Water Services Inc.

"In In re U.S. Water Services Inc., the U.S. Court of Appeals for the Federal Circuit said that the lower trial court mistakenly ruled on summary judgment that two U.S. Water Services Inc. patents were invalid based on anticipation and inherency by the prior art but affirmed the lower court’s denial of Novozyme’s summary judgment on inequitable conduct. The decision read, 'Vacated in Part, Affirmed in Part, and Remanded.' The Federal Circuit panel included Judges Evan J. Wallach, Todd M. Hughes, and Kara F. Stoll."
