San Rafael Rent Control Case Could Impact Thousands

Cooley attorneys recently prevailed in a long-standing (13 year, two trial and multiple appeal) litigation for pro bono client, Contempo Marin Homeowners Association (400 mobilehome owners in a park in San Rafael.)  National housing giant Equity Lifestyle Properties had persuaded former U.S. District Judge Vaughn Walker to strike down San Rafael's rent and vacancy control ordinance for violating the U. S. Constitution (due process and "takings" clauses).

The Ninth Circuit recently over-turned that ruling and has also refused to grant rehearing to ELS.  Last week, the Ninth Circuit refused to stay its decision pending a possible appeal to the U.S. Supreme Court, and this week the Ninth Circuit issued its "mandate," which reinstated the entire ordinance – a complete win. Nate Cooper worked on the recent Ninth Circuit motions, but more than 20 partners and associates (current and former) worked on the case over the past 13 years.
