Insights From the Front Lines of US and International Product Regulation

Members of the Cooley international products team provided an update on active regulatory and enforcement matters occurring worldwide. The products space is seeing a significant increase in the proposal and adoption of new regulations – and unprecedented aggressiveness in enforcement. Cooley associates Shawn Skolky, Lissie Ng, Julia Greaves and Jack Eastwood provided highlights from 2023, as well as their assessment of the quickly changing regulatory regime. One hour of continuing legal education (CLE) credit was available for this session.

Plenary Session 1: “Inside the Room Where It Happens” – Fostering Organizational Understanding for the New Landscape of CPSC Regulatory Enforcement and Penalty Investigations

Moderated by Matt Howsare, Cooley partner and chair of the firm’s North American product safety practice group, this session helped the people “inside the room where it happens” drive fully informed decision-making and create internal processes to ensure internal stakeholders have a thorough understanding of US Consumer Product Safety Commission (CPSC) reporting obligations, regulatory compliance, and the significantly heighted risks associated with shortcomings in either of those areas.

Breakout Session 9: How to Warn Against the Dangers of Hidden Hazards? Best Practices to Empower Consumers to Prevent CO Poisoning and Adopt Learnings to Identify and Address Other Hidden Hazards

Cooley associate Shawn Skolky moderated this panel focused on the silent dangers of carbon monoxide poisoning, including viewpoints from the National Carbon Monoxide Awareness Association, a retailer and a human factors expert. Panelists shared best practices to eradicate carbon monoxide poisoning, starting with efforts to partner with healthcare professionals, first responders, manufacturers, retailers, the media, educators and consumers of appliances/equipment emitting carbon monoxide, as well as operators of facilities in which such equipment is used. Information from this session can be applied to identify and remedy other hidden hazards.

Breakout Session 19: Using AI for Product Safety – the New Frontier of Collaboration?

How can digital innovations enhance product safety processes? During this session, moderated by Cooley special counsel Jamie Humphreys, participants learned about digital twins, other innovations involving artificial intelligence and machine learning, and why regulators are looking at how digital innovations can support their work.

Plenary Session 5: Say Goodbye to PFAS: What Product Manufacturers Can Expect From Regulatory Initiatives on PFAS

Per- and polyfluorinated substances (PFAS) are becoming the subject of greater regulation, with the European Union, the UK and the US all proposing initiatives to regulate or ban PFAS on their own and in consumer products in virtually every sector. At this stage, action on PFAS is largely uncoordinated, which may require product manufacturers to modify the material composition of – or in some cases, completely redesign – their products to comply with regional PFAS requirements. Moderated by Cooley associate Anushi Amin, this panel explored how PFAS are being regulated on both sides of the Atlantic – and the challenges and opportunities this will pose for product manufacturers.
