Session 1 – Building a Solid Foundation for Patent Protection
A patentable claim not only needs to be novel and nonobvious, but also it must be enabled by and sufficiently described in the specification. Recent developments in the US cast light on the importance of a well-drafted patent application in strengthening patented claims in patent litigation and potentially reducing patent prosecution costs in the future.
In this session, Cooley partner Chen Chen and associate Sam Matthews highlighted strategies for drafting embodiments, defining key terms and laying the groundwork for strong patent protection.
Session 2 – Implications of In Re: Cellect, LLC
In this session, Cooley lawyers discussed the Federal Circuit’s decision in In Re: Cellect, LLC and how it impacts the interplay of obviousness-type double patenting and patent term adjustment.
Session 3 – Weathering the Storm: In Search of a Safe Harbor
During this session, Cooley partner Sanya Sukduang and associate Bonnie Fletcher Price discussed the impact of recent decisions interpreting the “safe harbor” provisions and how “reasonably” your work is related to Food and Drug Administration activities.
