This session covers a range of privacy and cybersecurity topics related to the use and development of AI products and services, including consumer rights, data protection assessments, and other issues related to compliance with data privacy laws, data security, and current litigation trends.

This session will cover topics related to day-to-day commercial transactions and product development involving generative AI tools – including customer and vendor agreements for products and services, internal generative AI policies and practices, chatbot regulations, and data and content scraping and licensing.

This session covers ways to navigate the US, European Union and UK regulatory and legislative risks of AI, including strategies for engaging with policymaking bodies and analyzing the business impacts of legislation and regulations on innovation. Going beyond the text of new laws and rules, this session provides insights into the complex procedures of government agencies – and the people behind them – from US and international perspectives. Other topics of discussion include the applicability of current and proposed laws and regulations on AI platforms relating to unfair and deceptive practices, creation and monitoring for deepfakes, libel and explicit content concerns, and compliance with chatbot disclosures.

This session will cover myriad issues related to employment counseling and litigation from an AI perspective in the US and the UK. We will discuss best practices associated with AI-powered tools, including compliance with laws and administrative guidance concerning the use of these tools in employment decisions and managing generative AI usage by employees to perform their jobs. As part of our examination of the use of AI in the hiring and promotion process, we also will discuss bellwether New York City Local Law 144, a first-of-its-kind law that prohibits the use of qualifying AI-powered tools for employment decision-making without conducting an annual bias audit, as well as complying with publication and notification requirements.

Central to the conversation around artificial intelligence (AI) regulation are issues of enforcement by global antitrust agencies. Evident from the probes being launched over the last few months, antitrust agencies in the US, UK and European Union are taking strident measures to pursue a proactive enforcement agenda in the AI landscape.

This session will explore the ways in which agencies across key geographies are seeking to put in place guardrails and get “ahead of the curve” on antitrust issues that are evolving with the development of AI technologies – including matters related to entrenchment and business conduct, as well as other perspectives that will be relevant when considering expansion plans, go-to-market approaches, and strategic partnerships and dependencies.

This session will cover considerations for public companies related to artificial intelligence. As a rapidly growing number of questions arise across different areas of law concerning AI, companies and their management and boards are facing unprecedented challenges as they evaluate and leverage opportunities to use it – as well as mitigate its risks. With a targeted focus on public companies, this session will discuss key business implications and risks of AI, AI-related compliance considerations, anticipated areas of regulator focus and steps companies can take to address AI. While the session is primarily focused on US domestic issuers, general considerations that are applicable to foreign private issuers will be discussed.

As companies increasingly rely on AI to enhance the customer experience, improve internal efficiency, support decision-making and mitigate fraud risk, the regulatory landscape is quickly evolving. Consumer protection agencies and financial services regulators are increasingly concerned and messaging loudly that institutions will be held accountable for noncompliance with the law when – not if – AI-driven activities go awry.
