Successful Data Breach Case Against Caliber Home Loans

Cooley successfully defended Caliber Home Loans, Inc. (“Caliber”) against a putative class action filed by a Caliber customer seeking damages arising from a data security incident that resulted in notice to affected individuals. The complaint asserted claims for negligence, violation of the right to privacy under the California constitution, violation of Section 17200 of the California Business & Professions Code, and violation of the California Information Practices Act. The Court twice granted Cooley’s motions to dismiss Plaintiffs’ claims, and ultimately dismissed the case with prejudice.
