San Francisco – July 29, 2022 – Cooley secured a product line-saving trademark victory for Hailey Rhode Bieber and her companies, Rhodedeodato and HRBeauty, on July 22 when the US District Court for the Southern District of New York denied Rhode NYC’s motion for a preliminary injunction seeking to enjoin Bieber from offering her recently launched skin care line under the RHODE mark. Lawyers Michael Rhodes, Brendan Hughes, and Rebecca Givner-Forbes are leading the Cooley team advising Bieber and her companies.
Bieber spent years bringing her unique skin care line to market under her Rhode family name – a name inspired by, and passed down from, her great-grandmother to her mother to her. On June 15, Bieber launched her Rhode skin care line to great acclaim, selling out almost the entire inventory in one day.
On June 21, clothing brand Rhode NYC filed a complaint against Bieber and her companies alleging violations, including trademark infringement and unfair competition, under the federal Lanham Act and New York state law. In addition, Rhode NYC sought extraordinary relief through a preliminary injunction seeking to enjoin Bieber from selling her skin care line under the RHODE mark.
After considering extensive briefing and hearing oral argument, the court denied Rhode NYC’s motion on July 22. “My holding is that plaintiff is not entitled to a preliminary injunction because it has not demonstrated a likelihood of success on the merits on the federal trademark claim,” US District Judge Lorna Schofield said during the hearings. “And also, in the alternative and on the issue of the plaintiff showing both serious questions on the merits and the balance of hardships decidedly favoring plaintiff, my finding is that on the record the balance of hardships does not decidedly tip in favor of plaintiff.”
Rhodes, who serves as the Bieber family’s principal outside litigation counsel, said of the decision: “We are pleased with the court’s thorough order denying plaintiff’s motion to preliminarily enjoin Hailey’s new company and skin care line.”
The successful outcome earned the Cooley team a shout out as part of The American Lawyer’s Litigation Daily Litigator of the Week Runners-Up and Shout Outs list.
