Settlement Ending Four-Year Litigation for Mervyn's Estate and Creditors Committee

Represented the official committee of unsecured creditors for Mervyn's, a chain of approximately 175 department stores, and its estate in a highly contentious bankruptcy litigation the committee brought against various private equity firms, financial institutions and others that acquired Mervyn's from Target in a September 2004 LBO transaction. Four years after the suit was filed, Cooley secured a significant settlement that was approved by the US Bankruptcy Court for the District of Delaware in November 2012.
