John S. Kyle is a partner in the Intellectual Property Litigation practice group and is a member of the Cooley Litigation department. He joined the Firm in 2006 and is resident in the San Diego office.
Mr. Kyle's practice encompasses intellectual property litigation and business litigation. He has handled cases in the areas of wireless telecommunications (including CDMA and GSM), assisted GPS, digital video encoders/decoders, water purification systems, oil pumps, anti-spyware, e-commerce applications, and yacht designs. He has tried cases to juries and arbitrators and was named one of San Diego's top IP litigators by the Daily Transcript.
Prior to joining the Firm, Mr. Kyle was an associate at Procopio Cory Hargreaves & Savitch, in the intellectual property and litigation practice groups. Mr. Kyle also served as a tactical-jet pilot and logistics officer in the United States Marine Corps from 1987 to 1999, achieving the rank of Major.
He was recognized in the 2011 edition of San Diego Super Lawyers in the category of Intellectual Property Litigation.
Mr. Kyle received his J.D. from the University of San Diego in 1998, where he was Chairman of the Appellate Moot Court Board and was admitted to The Order of Barristers. He received his Bachelor of Science in Physical Sciences from the United States Naval Academy in 1987.
Mr. Kyle is admitted to practice before the United States Patent and Trademark Office; the U.S. District Court for the Southern, Central, and Northern Districts of California; the Ninth Circuit Court of Appeals; and is a member of the State Bar of California.
Representative matters include:
- Obtained summary judgment for Qualcomm in a misappropriation of trade secrets case in which plaintiff sought more than $150 million
- Represented Qualcomm in $1 billion patent dispute with Gabriel Technologies
- Represented Qualcomm as member of trial team in multi-billion dollar patent license dispute with Nokia. The case settled favorably for Qualcomm at the start of the trial.
- Represented Mutual Pharmaceuticals in obtaining a preliminary injunction against TEVA for false advertising of Quinine Sulfate.
- Represented Qualcomm in obtaining defense judgment in a lawsuit which sought more than $150 million in damages.
- Represented resort developer in $40 million victory as member of trial team in breach of partnership and fiduciary duty case – one of largest jury awards ever in the state of Arizona.
- Successful representation of wireless telecommunications client in $50 million patent infringement suit.
- Obtained walk-away settlement of $1.3 million breach of contract and fraud action against telecommunications client.
