Emily F. Burns is an associate in the Cooley Litigation department and a member of the Firm's Trademark, Copyright & Advertising practice group. She joined the Firm in 2003 and is a resident of the Palo Alto office.
Her practice involves business litigation, as well as trademark prosecution and counseling. Ms. Burns has represented large and small companies in contract, venture capital, RICO, unfair competition, breach of fiduciary duty and securities disputes in state and federal courts. Ms. Burns has also represented clients in a variety of alternative dispute resolution forums, including mediation and arbitration.
Ms. Burns' intellectual property practice encompasses trademark counseling, with an emphasis on the selection, adoption and use of trademarks, domestic and international trademark prosecution and enforcement, trademark portfolio management, and development of comprehensive branding strategies. Ms. Burns also represents clients in internet domain disputes in front of the World Intellectual Property Organization (WIPO). Ms. Burns has expertise in anti-counterfeit enforcement, including counterfeit trademark litigation in federal courts, and working with customs authorities in the US and throughout the world to detect and detain counterfeit goods. Ms. Burns is the co-author of Counterfeits: Beyond the Knockoff, National Law Journal, intellectual property supplement, October 16, 2006. Ms. Burns has also lectured and published in the area of Electronic Discovery, including co-authoring E-Discovery: One Year of the Amended Federal Rules of Civil Procedure, 64 N.Y.U. Ann. Surv. Am. L. 201 (2008).
Ms. Burns is an active contributor to the Firm's annual training program for junior attorneys, Cooley College. She is also on the adjunct faculty of UC Hastings, where she teaches Trademark Prosecution and Counseling. Ms. Burns has also served as a guest lecturer in Pre-Trial Procedures at Santa Clara University School of Law.
Ms. Burns received her J.D., magna cum laude, from the University of San Diego School of Law in 2003. During law school Ms. Burns acted as Lead Articles Editor on the San Diego Law Review, as well as contributing writer to the California Regulatory Law Reporter. She also served as an extern for the Hon. M. Margaret McKeown of the Ninth Circuit Court of Appeals. Ms. Burns is the recipient of the American Jurisprudence Awards in Federal Civil Procedure, California Civil Procedure, and Public Interest Law and Practice. In 2000, Ms. Burns received her B.A., summa cum laude, from San Diego State University in Political Science with an emphasis on Political Philosophy, where she was elected Outstanding Undergraduate Student in Political Science.
Ms. Burns is a member of the American Bar Association, State Bar of California and is admitted to practice in California and before the U.S. District Courts of Northern, Central, Eastern and Southern Districts of California.
